Deciding vote

    What is a deciding vote (Stichentscheid)?

    If your insurer refuses to give you a cover note for your case, you can get a decision based on a deciding vote (Stichentscheid).

    For this, your lawyer submits a statement to your insurer in which he answers the following questions:

    1. Is there a reasonable chance of success?
    2. Is the pursuit of your legal interests proportionate to the success you are seeking?

    The lawyer's decision is binding for both parties.

    Who pays for a deciding vote?

    The insurance company pays for the costs of the procedure.
